Biography

Koen has been a lawyer in the healthcare section since 2003. He specialises in legal services in the field of healthcare and regularly gives courses on legal issues that are relevant to healthcare. Koen has a primarily civil law practice and focuses (among other things) on healthcare procurement and contracting, the relationship between healthcare providers and healthcare insurers and the organisation of specialist medical care in hospitals as well as medical liability and medical disciplinary law. In recent years, Koen's proceedings against health insurers on the right to 'free choice of doctor' (article 13 of the Health Insurance Act), the prohibition of assignment and the authorisation requirement received a lot of national attention. These proceedings resulted in landmark judgments and rulings, which strengthened the position of healthcare providers.

Work highlights
  • The negotiations between several large (academic) hospitals and other healthcare providers and health insurers on contracts and financial conditions, resulting in the conclusion of contracts and large (additional) purchasing deals (more than 5 million) with several large health insurers. 

  • Representing several rehabilitation clinics in lawsuits against the largest health insurer in the Netherlands (Zilveren Kruis) for unlawfully demanding prior authorisation and sitting in the doctor's chair, resulting in several favourable verdicts.

  • (Re)shaping the cooperation between a medical specialist company (MSB) and a hospital.
