Litigation
Commercial conflicts are a daily occurrence. In today's dynamic market, companies constantly have to contend with legal challenges. Should litigation prove to be the sole option, both traditional adjudication and alternative dispute resolution methods, such as arbitration and mediation, can offer a solution.
Appropriately managing legal proceedings
Legal proceedings require quality, speed and dedication. Businesses may be confronted with various types of lawsuits, ranging from summary to complex substantive proceedings or arbitration. In order to manage legal proceedings successfully, it is essential to have both a strategic understanding and a thorough knowledge of property and procedural law.
Dirkzwager is a full-service firm that is capable of relieving you of all concerns. We litigate at all judicial levels, including on appeal to the Supreme Court. If necessary, we will represent you right up to the Supreme Court and back. If a case is one that requires the involvement of multiple areas of expertise, we will call on the appropriate specialists.

Commercial litigation
Business disputes demand a strategic understanding and appropriate knowledge. They may involve commercial contracts, such as those pertaining to purchases, collaboration, distribution, franchising and agency, or there may be disputes concerning general terms and conditions and extra-contractual liability, including professional or director’s liability.
Dirkzwager’s litigation lawyers act on behalf of businesses, including financial service providers, energy suppliers, IT enterprises, healthcare and educational institutions, and insurers. In addition, we have extensive experience of class action litigation.
Financial litigation
Financial institutions are increasingly having to contend with legal disputes ranging from those involving breaches of the duty of care and complex financial products, such as interest rate derivatives, to issues pertaining to consumer loan agreements, the termination of credit relationships and investment advice. Legal assistance is also often required for ESG disputes and pension matters. These institutions, which include credit providers, insurers, and investment firms, as well as (semi-)public organisations and large corporations, require specialist legal expertise in the case of (potential) breaches of the duty of care.
Dirkzwager combines an in-depth knowledge of the financial sector with professional legal work. Our specialists conduct litigation before both civil courts and complaints handling bodies such as the Dutch Financial Disputes Institute (Kifid). Our experience extends to complex civil proceedings, such as class actions involving financial products.
