Land policy
In the current market there is a growing demand for limited areas of land, with various demands being made on space, such as that for the installation of solar panels and for infrastructure (roads and railways), nature reserves and residential areas. In addition, the energy transition requires the installation of cables, pipelines and similar facilities. To support these developments a public authority or grid manager sometimes requires access to land owned by a third party, which in extreme cases may result in proceedings to secure a wayleave or expropriation. The Environment and Planning Act has significantly altered the procedures for this purpose.
Compensation claim proceedings
Increasingly complex debates are occurring with regard to compensation for government intervention, including expropriations, wayleaves, disadvantages or losses. Competition for limited space has led to more legal proceedings and challenges involving planning harm, land policy and compensation for disadvantages, wayleaves and expropriation.
Dirkzwager provides specialist support in such complex proceedings, ensuring that our experienced specialists deliver effective advocacy and expert legal assistance.

Pipes and cables in the energy transition
Although the Netherlands has an extensive network of cables and pipelines for gas, water and electricity, it may be necessary to relocate or build infrastructure because of the energy transition. This naturally raises questions. How can this best be done? Who is responsible for the costs? Who is liable in the event that this network is damaged?
Dirkzwager assists with the acquisition of the requisite licences and permits, the resolution of legal disputes and litigation.
