Dirkzwager is one of the few firms - and also the largest firm - outside the Randstad conurbation with its own cassation practice. The practice was started by Tom van Malssen in 2017. It now has a team of five lawyers, including, therefore, two lawyers at the Supreme Court. The cassation team handles cases on a variety of subfields of civil law, but with an emphasis on four areas of law: government privilege law, health law, liability law and procedural law. Van Malssen and Andes are also academically active in the field of civil procedural law (in particular). They sit on the editorial boards of several professional journals (TCR, JBPr) and publish regularly.
Over the years, the cassation team has built up a solid track record . And that is catching on. Initially the cassation team handled mainly 'internal' cassation cases, i.e. cases in which Dirkzwager lawyers were also involved in the actual proceedings. In the meantime, external parties also know how to find Dirkzwager's cassation lawyers. These may be lawyers from other law firms, but also 'underlying' litigants, such as municipalities, health care institutions or (non-life) insurers. For them, Dirkzwager is an attractive option: the cassation team provides high quality, but at more competitive rates than the Randstad offices with a traditionally large cassation practice.
